| Relationship between traditional knowledge protection of traditional Chinese medicine and intellectual property system |

Abstract The traditional knowledge protection of traditional Chinese medicine and the intellectual property system are relatively independent and cross each other. The existing intellectual property system in China protects traditional knowledge of traditional Chinese medicine in four aspects: patent, trademark right, copyright and trade secret. However, due to the particularity of differences in protection purpose, right object and protection mode, relying only on the intellectual property system cannot improve and effectively protect traditional knowledge of traditional Chinese medicine. The intellectual property system and traditional knowledge protection will complement and integrate each other, and a special protection mode of traditional Chinese medicine knowledge will be set up on the basis of intellectual property protection, so as to build a comprehensive protection system of traditional Chinese medicine knowledge in line with the characteristics of traditional Chinese medicine.
