论中医药传统知识保护对解决中医药“不传”之痛的意义

摘要中医药“秘而不传”的传承特点影响了中医药守正创新，需要从制度层面解决这一问题。文章分析了中医药“秘而不传”的原因，指出中医药传统知识保护是解决中医药“不传”问题的有效制度方案。建立收集整理网络，有助于理清中医药传统知识家底，防止技术失传；通过专门知识产权确权的方式，保障持有人的应有权利；通过建立合作开发推广机制，革新相对保守的中医药传承模式。诸措并举，最终提升中医药服务能力，不断满足人民群众日益增长的健康需求。

Abstract：The inheritance characteristic of traditional Chinese medicine is “secret but not transmitted”, which affects the integrity and innovation of traditional Chinese medicine, and this problem needs to be solved from the system level. this paper analyzes the reasons why traditional Chinese medicine is “secret but not transmitted”, and points out that the protection of traditional knowledge of Chinese medicine is an effective system to solve the “not transmitted” problem of traditional Chinese medicine. The establishment of a collection network is helpful to clarify the background of traditional knowledge of Chinese medicine and prevent the loss of medical techniques. Through the specialized intellectual property right confirmation, the rights of holders of traditional knowledge of Chinese medicine can be protected; through the cooperative mechanism of development and promotion, the conservative inheritance mode of traditional Chinese medicine can be reformed. All measures should be taken to improve the service capacity of traditional Chinese medicine and meet people’s growing health needs.
