Abstract：Since the founding of people′s Republic of China 70 years ago, with the promulgation of The Chinese Medicine Law of the People′s Republic of China, the concept of “healthy China” has been put forward, and traditional Chinese medicine has ushered in unprecedented opportunities for development. The inheritance and development of traditional Chinese medicine has become an important policy and strategy of the party and the state, and the inheritance of traditional Chinese medicine culture and the protection of intellectual property rights of traditional Chinese medicine are the key links. They promote each other and complement each other. Based on the background of independent innovation in the new era, this paper attempts to explore the path of traditional Chinese medicine cultural heritage and intellectual property protection of traditional Chinese medicine, and puts forward countermeasures and suggestions.
